1. Acceptance of Terms

By accessing or using the Daily Drive website, mobile application, or any related services (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Platform. We reserve the right to update or modify these Terms at any time. Your continued use of the Platform following any changes constitutes acceptance of those changes.

2. Eligibility

You must be at least 18 years of age and possess a valid driver’s license to use the Platform. By using our services, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into a binding agreement.

3. Description of Services

Daily Drive operates as a luxury car leasing concierge platform. We connect clients with premium vehicles through our network of authorized dealers, leasing companies, and financing partners. Our services include vehicle discovery, personalized recommendations, lease quote facilitation, and concierge-level support throughout the leasing process.

Daily Drive is not a dealer, lender, or lessor. We act as an intermediary to facilitate transactions between you and our third-party partners. All lease agreements, financing terms, and vehicle sales are between you and the respective dealer or leasing company.

4. Account Registration

To access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

5. Vehicle Listings & Availability

Vehicle listings, pricing, specifications, and availability displayed on the Platform are provided for informational purposes and are subject to change without notice. While we strive to keep listings accurate and up to date, we do not guarantee the availability, condition, mileage, pricing, or specifications of any vehicle listed. Images may not reflect the exact vehicle available.

6. Application & Credit Approval

Submitting a leasing application through the Platform does not guarantee approval, specific lease terms, or vehicle availability. All applications are subject to review, identity verification, credit evaluation by our financing partners, and dealer approval. We reserve the right to decline any application at our discretion.

By submitting an application, you authorize Daily Drive and our partners to obtain consumer reports and verify the information you provide, including but not limited to your identity, employment, income, and creditworthiness, in accordance with applicable law.

7. Lease Agreements

Any lease agreement you enter into is between you and the applicable dealer or leasing company — not Daily Drive. You are responsible for reviewing and understanding the full terms of any lease before signing. Daily Drive makes no representations or warranties regarding the terms, conditions, or suitability of any lease offered by our partners.

8. Pricing, Fees & Payments

All prices displayed on the Platform are estimates and may vary based on credit approval, dealer terms, taxes, registration fees, and other factors. Final pricing will be determined by the lease agreement between you and the dealer or leasing company.

Daily Drive may charge service or concierge fees for certain services, which will be disclosed to you before any transaction is finalized. Reservation deposits, if applicable, are subject to the refund policy disclosed at the time of payment.

9. Cancellations & Refunds

Cancellation and refund policies vary depending on the stage of the leasing process and the specific dealer or leasing company involved. Any reservation deposits are subject to the refund terms disclosed at the time of payment. Once a lease agreement has been executed with a dealer or leasing company, cancellation terms are governed by that agreement and applicable law.

10. User Conduct

You agree not to:

• Provide false, misleading, or fraudulent information in any application or communication
• Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to the Platform, other user accounts, or our systems
• Interfere with or disrupt the integrity or performance of the Platform
• Reproduce, distribute, or create derivative works of any content on the Platform without our prior written consent
• Use automated systems, bots, or scraping tools to access or collect data from the Platform

11. Intellectual Property

All content on the Platform — including text, graphics, logos, images, software, and trademarks — is the property of Daily Drive or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content from the Platform without our prior written consent.

12. Third-Party Links & Services

The Platform may contain links to third-party websites or services that are not owned or controlled by Daily Drive. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. Your use of third-party services is at your own risk.

13. Disclaimers

THE PLATFORM AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DAILY DRIVE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

DAILY DRIVE DOES NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF ANY VEHICLE LISTING, PRICING INFORMATION, OR LEASE TERMS DISPLAYED ON THE PLATFORM.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILY DRIVE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

Daily Drive acts as an intermediary and is not responsible for the condition of vehicles, lease terms set by partners, disputes arising from lease agreements, or any actions or omissions of third-party dealers, lenders, or leasing companies.

15. Indemnification

You agree to indemnify, defend, and hold harmless Daily Drive and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

16. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, with arbitration taking place in Miami, Florida.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in Miami-Dade County, Florida.

18. Termination

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Daily Drive regarding your use of the Platform and supersede all prior agreements and understandings.
